By shipping your item(s) to us, you agree to these Terms and Conditions. Any attempt to modify these Terms and Conditions will be void unless such modifications are agreed to in writing by an authorized representative of Tulsa Gold and Gems, Inc.

1. FORM COMPLETION

TULSA GOLD AND GEMS, INC. WILL NOT SEND YOU A CHECK FOR YOUR ITEM(S) UNTIL WE HAVE RECEIVED A COMPLETED SALES FORM WITH YOUR ORIGINAL SIGNATURE AND A COPY OF THE FRONT AND BACK OF YOUR VALID DRIVER’S LICENSE OR FEDERAL GOVERNMENT-ISSUED IDENTIFICATION CARD. TULSA GOLD AND GEMS, INC. RESERVES THE RIGHT, IN THE EXERCISE OF ITS SOLE DISCRETION, TO REQUIRE ADDITIONAL PROOF OF OWNERSHIP AND/OR COMPLIANCE WITH THESE TERMS AND CONDITIONS BEFORE PURCHASING YOUR ITEM(S).

2. EVALUATION

Upon receiving your item(s), our experts will determine both the level of quality and purity and the weight of your item(s) and/or amount of precious metal contained within your item(s). ALL DETERMINATIONS BY OUR EX-PERTS CONCERNING QUALITY, PURITY, WEIGHT AND OTHER ISSUES WILL BE FINAL.

3. PAYMENT

The price we will pay for your item(s) will be based upon our experts’ evaluation. We will send you an offer via e-mail  within 72 hours from the receipt of your items.  You will have 48 hours to decline our offer.  If you do not decline our offer within 48 hours from the time it was sent, the offer will be deemed accepted.  Upon offer acceptance we send you a check within 72 hours via FedEx Overnight Standard representing the total purchase price for your item(s).

IF YOU CHANGE YOUR MIND ABOUT SELLING YOUR ITEM(S) TO US OR ARE UNHAPPY WITH OUR PRICE, YOU MUST NOTIFY US IMMEDIATELY. IF WE DO NOT HEAR FROM YOU, VIA EMAIL, WITHIN 72 HOURS OF CHECK DELIVERY, OUR PURCHASE OF YOUR ITEM(S) WILL BE DEEMED FINALIZED. THERE WILL BE NO EXCEPTIONS TO THIS TIME LIMIT. YOU MUST RETURN OUR UNCASHED CHECK TO US BEFORE YOUR ITEMS(S) ARE RETURNED.

TULSA GOLD AND GEMS, INC. WILL NOT BE RESPONSIBLE FOR ANY DAMAGE TO OR THEFT OF YOUR ITEM(S) WHILE THEY ARE BEING TRANSPORTED TO OR FROM TULSA GOLD AND GEMS, INC. LIABILITY FOR DAMAGES TO YOUR ITEM(S) WHILE SUCH ITEM(S) ARE IN OUR POSSESSION SHALL BE LIMITED TO THE LESSER OF OUR PURCHASE PRICE OR ONE HUNDRED DOLLARS ($100). TULSA GOLD AND GEMS, INC. OFFERS UP TO $5000 DOLLARS INSURANCE COVERAGE FOR YOUR ITEMS DURING SHIPMENT. YOU WILL ONLY QUALIFY FOR THE $5000 INSURANCE COVERAGE IF YOU SHIP YOUR ITEMS IN A MEDIUM SIZED FEDEX BOX SENT VIA OUR FREE FEDEX EXPRESS SAVER SHIPPING SERVICE. INSURANCE COVERAGE IS DEPENDENT UPON PROOF OF OWNERSHIP AND SHIPMENT.

6. DISPUTES

In the event of a dispute between you and Tulsa Gold and Gems, Inc., such disputes shall be settled by good faith negotiations between the parties. If these negotiations fail, each of the parties agrees to submit to the jurisdiction of the state and federal courts sitting in Tulsa County, Oklahoma. To the extent not otherwise addressed by these Terms and Conditions, any dispute between the parties shall be governed by the laws of the State of Oklahoma without regard to principles of conflicts of laws.

7. TAXES

You bear all responsibility for any and all applicable federal, state and local taxes, including, but not limited to any and all sales tax, that may be applicable to you as a result of selling your item(s) to Tulsa Gold and Gems, Inc.

8. DEFINITIVE CONTRACT

These Terms and Conditions, together with the “Sale Record Sheet” submitted with your item(s), set forth the entire understanding between you and Tulsa Gold and Gems, Inc. concerning Tulsa Gold and Gems, Inc.’s purchase of your item(s).
